Gambling laws in Indonesia

In July 2025, the Indonesian Ministry of Communication and Digital Affairs announced stricter regulations surrounding online gambling, with it titled “Government Regulation on Online Gambling Education”. 

The new gambling laws will cover the prevention and enforcement of these measures, while also giving new powers to authorities to penalise operators, digital platforms and financial technology providers.

Muslims stance on gambling

In 1991, Indonesia briefly legalised gambling under the banner of “Social Donor Contributions with prizes” in an attempt to regulate the thriving lottery scene that had been widespread since the 1970s.

However, this move faced fierce backlash from religious scholars, particularly within the country’s Muslim majority. In Islam, gambling — known as maisir or qimar — is explicitly prohibited under Sharia law. Many Muslim scholars emphasise that any form of wagering for profit is considered haram (forbidden), regardless of whether it is state-regulated or privately run.

This religious opposition quickly pressured the government to reverse course, reinstating a nationwide gambling ban. The legal history of gambling in Indonesia therefore reflects an ongoing tension between attempts at legalisation and the unwavering stance of Islamic scholars.

Despite this, millions of Indonesians still gamble online, raising speculation that the law may eventually be revisited. Efforts to curb the practice have been multifaceted, with the Ministry of Communication and Information blocking websites, freezing affiliated bank accounts, and targeting e-wallets. Yet such measures have proven only partially effective, as many platforms remain accessible.

A 2021 joint decree by the government and police expanded the definition of online gambling to include advertising, billing, operating, bookmaking, playing, and even possessing gambling accounts. Offenders face up to 10 years in prison, underscoring the severity of Indonesia’s anti-gambling stance.

Still, enforcement is inconsistent. Even the military, police, and government agencies — all of which have had personnel caught gambling online — have struggled to stamp out the practice.

While religious beliefs are all well and good, the World Gambling List firmly believes Indonesia needs to regulate online gambling, at least partially to give those struggling with addiction guardrails.
