Massachusetts Gaming Commission reopen wagering license applications
The Massachusetts Gaming Commission has voted unanimously to reopen the state’s sports wagering licensing process, following a request from bet365 to enter the market.
The decision, made during Public Meeting #586, allows new applicants to pursue available licences, including category 3 mobile-only permits.

Staff attorney Justin Stempeck confirmed bet365 is targeting an untethered Category 3 licence, which would allow the operator to offer online betting without partnering with a land-based casino or racetrack.
Massachusetts law permits up to 16 mobile licences, but only seven are currently active, leaving significant room for expansion. Existing operators include BallyBet, BetMGM, Caesars, DraftKings, Fanatics, FanDuel and Penn Interactive.
The Commission will begin accepting Notices of Intent immediately, with a submission deadline of May 15, 2026. If applications exceed the number of available licences, a competitive evaluation process will be triggered.
bet365 already operates in 16 US states, including New Jersey, Ohio and Pennsylvania, and its potential entry would further intensify competition in one of the country’s most established regulated betting markets.
The move signals Massachusetts is open to expanding its online wagering landscape amid ongoing operator interest.
